This Acceptable Use Policy ("Policy") governs your use of the ChamaPay platform, operated by Nelimax Technologies. By accessing or using ChamaPay, you agree to comply with this Policy. Violations may result in suspension or termination of your account.
1. Lawful Use Only
You may use ChamaPay only for lawful purposes and in accordance with the laws of the Kenya and any other applicable jurisdiction. You may not use the Platform for any illegal activity, including money laundering, fraud, terrorism financing, or any activity that violates anti-corruption or financial regulations.
2. Authorized Access
Access to ChamaPay requires a valid access code issued by your Chama administrator. You are responsible for keeping your access code, PIN, and credentials confidential. You may not share your credentials with unauthorized persons, attempt to access another member's or Chama's account, or impersonate any user or Chama.
3. Prohibited Activities
You agree not to:
- Use the Platform for any unlawful or fraudulent purpose;
- Attempt to access, view, or modify another Chama's data or another member's account;
- Introduce malware, viruses, or any harmful code to the Platform;
- Reverse engineer, decompile, or attempt to extract the Platform's source code;
- Use bots, scrapers, or automated tools to access the Platform without authorization;
- Manipulate financial records, contributions, loan data, or fines;
- Submit false payment confirmations or circumvent M-Pesa payment mechanisms;
- Harass, threaten, or abuse other members, Chama Admins, or ChamaPay staff;
- Post or transmit obscene, defamatory, hateful, or discriminatory content;
- Use the Platform to send unsolicited bulk messages or spam.
4. Data & Document Uploads
Members may upload identification documents, loan agreements, and other files. You are responsible for the accuracy, authenticity, and legality of anything you upload. ChamaPay reserves the right to remove any document that violates this Policy or applicable law. Uploaded documents are accessible only to authorized members and administrators of your Chama.
5. Multi-Tenant Isolation
Each Chama operates in an isolated data environment. You may not attempt to access, bypass, or circumvent the isolation between Chamas. ChamaPay's technical staff may access data only for maintenance and support under strict security protocols.
6. Member & Admin Responsibilities
Chama Admins are responsible for managing their Chama's membership, including approving members, setting contribution rules, configuring fines, and removing members who violate the Chama's constitution or this Policy. Members must comply with their Chama's rules as administered through the Platform.
7. Financial Conduct
ChamaPay is a technology platform and is not a bank, SACCO, or licensed financial institution. All funds move directly between members' M-Pesa accounts and the Chama's designated payment account. You must not use ChamaPay to facilitate payments for illegal goods or services, or to evade financial reporting or tax obligations.
8. Monitoring & Enforcement
ChamaPay may monitor usage of the Platform to detect violations of this Policy. If we suspect a violation, we may suspend or terminate access, remove content, or report the activity to appropriate authorities. We are not liable for disputes between Chama members or for financial decisions made by a Chama or its Admin.
9. Termination
ChamaPay may suspend or terminate your access to the Platform at any time, with or without notice, for violation of this Policy, the Terms of Service, or applicable law. Upon termination, your right to use the Platform ceases immediately.
10. Changes to This Policy
We may update this Acceptable Use Policy periodically. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance of the revised Policy.
